Upstate New York Physician Pleads Guilty to Healthcare Fraud

An Indian-American in northern New York state pleaded guilty to hundreds of thousands of dollars in healthcare fraud and faces a significant jail term upon sentencing.

On January 22, Dr. Mahesh Kuthuru, 44, of Baldwinsville, pleaded guilty to issuing illegal prescriptions for controlled substances. Kuthuru formerly ran offices in Central New York. Kuthuru benefited from the Medicare fraud to the tune of $82,986, according to a release from the U.S. Attorney for the Northern District of New York.

He faces a maximum 10-year prison term and a fine of $250,000 on the health care fraud charge and a one year term of imprisonment and a $100,000 fine on the unlawful dispensation of controlled substance prescription charge.

From January 2010 through September 2011 in the course of his practice at Upstate Pain Management, with offices at 59 South First Street, Fulton, New York and 287 Genesee Street, Utica. The Indian-American physician admitted that he submitted bills to Medicare which falsely reflected that he had personally provided or directly supervised other licensed medical personnel providing treatment or services to patients in the Fulton and Utica offices.

In fact, Kuthuru was out of town either outside the United States or in Las Vegas, Nevada, where he operated another medical known as Dessert Pain Management.
In addition to lying about personally providing services, Kuthuru also pled guilty to illegally issuing prescriptions for controlled substances from his New York practice. These prescriptions were also signed by him while away from his New York practice.
